These businesses, venues, promoters, users, companies, and organisations may incur a payment fee to broadcast on our app and services. However, in some instances, using popiin ™ app and services may not incur a fee and will be shown free of charge to use and access. Our services will provide businesses, venues, promoters, companies, and organisations with reports about the services we provide to help them understand how users use and interact with their content.

You have the right to remove and delete your personal information. By registering, submitting any information in any way we will ask you to expressively agree to the terms and conditions. You must be at least sixteen [16] years of age to use the app; by agreeing to these terms and conditions, you represent to us that you are at least sixteen [16] years of age. The type of information that we collect, and process depends on how you use our services. We collect your personal information, the content, and any other data you provide when you use our app and services, including when you register for an account, login, browse, use, create, invite, or share content all designed for your user experience.

We work with third-party services to provide content, and users can upload content to promote their own services thus in some cases the content on display is not owned by popiin ™. This content is the sole responsibility of the user that makes it available in our app. We may review content to determine whether it is illegal or violates our policies, approve and decline, and remove or refuse to display content that we reasonably believe violates our policies or the law. All data, information, documents, files, reports, materials, images, designs, text, logos, forms, pages, screens, buttons and thereof, including your personal information are used and processed to give you the best user experience and to show you relevant content for your own interests and preferences.

We don't sell your personal data to businesses, venues, promoters, users, companies and organisations and we don't share information – for example your name, email address, documents or other contact information with any businesses, venues, promoters, users, companies and organisations unless you give us specific permission to do so. We ask you for specific information tailored to your bookings, verification documents to authorise your account and for marketing permission in order to communicate our services that we think could be of interests to you and to show you personalised content that could be helpful and exclusive to your interests and preferences.

In these terms and conditions, “your content" is referred to all data, documents, information and materials that you submit for processing or publication on the app. You grant to us a worldwide, irrevocable, non-exclusive, royalty-free license to access, rights to sub-license, use, reproduce, store, adapt, publish, translate, transmit, modify, distribute and create derivative works based on your content in any existing or future media or reproduce, store and publish your content on and in relation to popiin ™ and any successor app or reproduce, store and, with your specific consent, publish your content on and in relation to popiin ™. You hereby waive all your moral rights in your content to the maximum extent permitted by applicable law and you warrant and represent that all other moral rights in your content have been waived to the maximum extent permitted by applicable law. You may edit or remove your content to the extent permitted using the editing feature or deletion functionality made available on the app.

You are responsible for your use of the app and services and for any personal information and content that you provide, including compliance with applicable laws, rules, and regulations. You may only use our services for your own personal and business purposes but you must not use our website or app for any other purposes.

We are aware that our services will give users direction and allow users to travel to locations, places and venues; we strongly advise that you carry out safety checks and you don’t travel to places that may be unsafe, and to take care when making travel arrangements to ensure you obey traffic and safety laws. In connection with your use of our app, we may send you service updates, messages, and other information from time to time to keep you informed.

Using our app does not give you ownership of any intellectual property rights in our app or the content you access. You may not use content from our app unless you obtain permission from its owner or are otherwise permitted by law. These terms do not grant you the right to use any content used throughout our app for your own personal use. Don’t remove, obscure, interfere or alter any content or information that does not belong to you or have not been granted access to use.

If you use content covered by intellectual property rights that we have and make available (for example, images, designs, videos etc that we provide, which you add to the content that you create or share), we retain all rights to that content (but not yours).

Without prejudice to our other rights under these terms and conditions, if you breach any provision of these terms and conditions in any way, or if we reasonably suspect that you have breached these terms and conditions in any way, popiin ™ reserve the right to suspend or stop providing our app to you, delete and remove any of your personal information, data and content from the app at any time.

Your personal information, and the use of your content by us in accordance with these terms and conditions must not be libellous or maliciously false, unlawful, threatening, abusive, harassing, defamatory, deceptive, fraudulent, invasive of another's privacy, tortious, obscene, vulgar, pornographic, offensive, profane, contains or depicts nudity, contains or depicts sexual activity, promotes bigotry, discrimination or violence, or is otherwise inappropriate as determined by popiin ™.

Be in infringement of any copyright, moral, database, trade secret trademark, design right, right in passing off, or other intellectual property right; infringe any right of confidence, right of privacy or right under data protection legislation; be untrue, false, inaccurate or misleading; interfere with, disrupt or damage the service given to any user in any manner, including, without limitation, submitting a virus to the app or attempting to overload, “flood,” “spam,” “mail bomb” or “crash” the app; ii) scanning or monitoring the app for data gathering purposes in an effort to track sales, usage, aggregate offering information, pricing information or similar data; iii) scanning or testing the security or configuration of the app or to breach security or authentication measures; or iv) accessing data not intended for you, such as logging into an account which you are not authorized to access.

Be in breach of racial or religious hatred or discrimination legislation; depict violence in an explicit, graphic or gratuitous manner, be pornographic whether it’s lewd, suggestive or sexually explicit; consist of or contain any instructions, advice or other information which may be acted upon and could, if acted upon, cause illness, injury or death, or any other loss or damage; be offensive, deceptive, fraudulent, threatening, abusive, harassing, anti-social, menacing, hateful, discriminatory or inflammatory and must not cause annoyance, inconvenience or needless anxiety to any person.

Furthermore, in terms of acceptable use - you must not use our app in any way that is unlawful, illegal, fraudulent or harmful, or in connection with any unlawful, illegal, fraudulent or harmful purpose or activity; conduct any systematic or automated data collection activities (including without limitation scraping, data mining, data extraction and data harvesting) on or in relation to our app without our written consent.

You must not misuse our app or services in any way. Don’t try to access our content using a technique other than the method made available and the instructions that we provide. You may use our app only as permitted by law. Unless you own or control the relevant rights of your content, you must not republish content, sell, rent or sub-license content from our website or app (including republication on another website or app), exploit or redistribute content from our website or app for commercial purposes. You must not circumvent or bypass, or attempt to circumvent or bypass, any access restriction measures on our website or app. We reserve the right to restrict access to areas of our website or app, or indeed our whole website or app, at our discretion.

If you do not verify and validate your account and/or your venue, we reserve the right to suspend, cancel, block, or delete your account, and you will no longer have access to our services. You may be asked to present your ID for age verification and must comply with the content rules set out in the app and/or website. You must not use your account for, or in connection with, the impersonation of any person.

You must not allow any other person to use your account to access the app and/or website services. Similarly, you must not use another person's account to access the app and/or website unless you have that person's express permission and authority to do so.

To protect and secure your account, you must keep your password confidential. We will never ask you to share your password. You are responsible for the activity that occurs on and through your account and may be held liable for any losses arising from failure to secure your account. You must notify and contact us immediately if you become aware of any unauthorised use of your account.

To the extent that our app and the information and services on our app are provided free of charge, we will not be liable for any loss or damage of any nature. We will not be liable to you in respect of any losses arising out of any event or events beyond our reasonable control.

We will not be liable to you in respect of any special, indirect or consequential loss or damage.

You accept that we have an interest in limiting the personal liability of our staff and employees and, having regard to that interest, you acknowledge that we are a limited liability company which means you agree that you will not bring any claim personally against our staff or employees in respect of any losses you suffer in connection with the app or these terms and conditions. However, this will not, of course, limit or exclude the liability of the limited liability entity itself for the acts and omissions of our staff and employees.

Nothing in these terms and conditions are intended to exclude or limit popiin ™'s liability for death or personal injury; fraud; fraudulent misrepresentation; any implied terms as to title which cannot be excluded or limited by law; or any liability that cannot be excluded or limited by law.

If we suspend, cancel, prohibit, delete, or block your access to our services, you must not take any action to circumvent such suspension, prohibition, cancellation, deletion, or blocking, such as creating or using a different account.

We reserve the right to discontinue or alter any or all of our website or app services, and to stop publishing our website or app, at any time in our sole discretion without notice or explanation and save to the extent expressly provided otherwise in these terms and conditions, you will not be entitled to any compensation or payment upon the discontinuance or alteration of any of our website or app services, or if we stop publishing the website or app.

We use third-party services and integrations for enhanced security and protection, which means processing fees, service fees, usage fees, and transaction fees may be applied to your bookings, refunds, and payment withdrawals. Such fees are subject to change to secure, protect, develop, and provide our users with the best products, features, and services. Our third-party providers maintain security, technical, and administrative measures designed to protect your personal data against unauthorised access, destruction, loss, alteration, or misuse. Therefore, we may update our booking and payment processes, fees, and prices periodically to ensure we can operate and deliver services safely and securely to all users. Moreover, we may restrict bookings and quantities at any time to ensure fair and legitimate usage, as well as for validity and compliance with third-party services, companies, promoters, partners, venues, and organisations. You must complete the payment set up process in the active session to securely activate and protect your account with our third-party service. Otherwise, you will have to go through the full payment set up and authentication process again.

Your personal data is accessible only to a limited number of personnel who require it to perform their duties, and authorisation measures are in place for accessing such data. While no data transmission or storage system can be guaranteed to be 100% secure, we apply strict measures to ensure good security and protection. We also perform regular maintenance and testing to maintain high security standards and procedures to safeguard your data. In the event of fraudulent or suspicious activities, we aim to process your request in a timely and orderly manner, carrying out further checks for verification purposes to resolve any issues. We believe this approach ensures your data is adequately managed, and reasonable efforts are made to provide security appropriate to the risks associated with data processing. For bookings and cancellations: if an event you have booked is cancelled, we will honour refunds, though fees may be non-refundable. Refunds will be assessed on a case- by-case basis because, each time a transaction is processed, fees are mandatory to facilitate payment and operate our services. We will do our best to honour users wishes for continuing to use and support our products and services.

If the details are incorrect, your payment may be cancelled, or you may be required to verify that the account details belong to you and that you are authorised to access the account. We aim to process all withdrawal requests within 14 days. Withdrawals are subject to a 5% processing fee, provided that all bookings and payments have been successfully cleared and securely verified. However, withdrawal requests cannot be made until the event(s) associated with your account have concluded, and all bookings have been validated. If any booking or transaction is flagged as suspicious or fraudulent, funds may be held indefinitely pending an investigation. Please note that there is no fixed timeframe for resolving withdrawal disputes, as these are managed by our third-party provider, and while we will help and support, we do not handle payment processing directly.

You may not without our prior written consent assign, transfer, sub-contract or otherwise deal with any of your rights and/or obligations under these terms and conditions.
